Refund Policy

By accessing and using the services of BeCare Health ("Service"), you agree to the Refund Policy. If you do not agree, we ask that you do not use our services.

1. General Scope and Purpose

The purpose of this Refund Policy is to ensure clarity and transparency for our customers regarding subscription fees, payment terms, and refund procedures. This policy outlines your rights and obligations as a subscriber, including specific details on cancellations, refunds, penalties, and interest charges that may apply in cases of missed payments. BeCare Health is committed to providing high-quality telehealth services while maintaining compliance with financial regulations, ensuring that all transactions adhere to legal standards of transparency and fairness.

2. Acceptance of Terms

By subscribing to any of BeCare Health’s services, customers acknowledge and agree to comply with the terms of this Refund Policy. Each customer is responsible for understanding the financial commitment associated with their chosen plan, including any penalties, fees, or interest charges that may apply in the event of early cancellation or payment failure. BeCare Health reserves the right to modify this Refund Policy as necessary, in accordance with applicable Florida laws, and will notify subscribers of any significant changes to these terms.

3. Regulatory Compliance

BeCare Health operates as a Florida-based company and adheres to all relevant state and federal regulations in the U.S. regarding telehealth services, credit card processing, and financial transactions. Our commitment to regulatory compliance ensures that all our policies, including this Refund Policy, are designed to protect customer rights and maintain fair business practices. Customers are encouraged to review this policy regularly, as ongoing compliance efforts may result in updates to these terms.

4. Customer Rights and Responsibilities

Customers subscribing to BeCare Health services are entitled to a complete understanding of their payment obligations, including any rights they may have under Florida law to cancel or modify their subscription plans. Subscribers have the right to communicate directly with our Customer Support team to request information, ask questions, or report any concerns regarding charges, penalties, or service access. BeCare Health’s commitment to customer satisfaction is supported by our multilingual support team, available in both Portuguese and English.

5. Refund Limitations

This Refund Policy establishes specific conditions under which refunds may be granted. While some plans are eligible for cancellation with penalties, full refunds are generally not offered once services have been rendered. BeCare Health reserves the right to deny a refund request if the service has been used or if the cancellation does not meet the terms outlined for each subscription type. Exceptions to this rule will only be considered at BeCare Health’s sole discretion and only if they comply with Florida state laws.

6. Penalties and Interest Charges

BeCare Health’s refund and cancellation terms include specific penalties and interest charges to compensate for costs associated with early contract terminations and payment failures. These charges are calculated to be fair and transparent, aligning with regulatory guidelines. Customers agree to these terms upon subscribing to the service, and any disputes related to penalties will be handled by our Customer Support team in accordance with Florida law.

7. Dispute Resolution

In the event of any dispute or disagreement regarding this Refund Policy, BeCare Health encourages customers to first contact our Customer Support team for resolution. Disputes that cannot be resolved through standard customer service channels may be escalated, and BeCare Health will make all reasonable efforts to reach an amicable solution that respects both customer needs and the company’s contractual obligations. This policy is subject to the jurisdiction of Florida courts, and customers agree to abide by these legal channels if necessary.

8. Auto-Renewal Terms

For customers with an annual subscription, this policy includes the option to disable auto-renewal before the completion of the 12-month period. Disabling auto-renewal ensures that no additional charges will be made after the subscription term ends. This flexibility is provided to help customers manage their financial obligations and maintain control over their subscription status. Customers can contact Customer Support to enable or disable auto-renewal at any time under the terms of this policy.

Annual Subscription Plan
For our annual subscription plan, customers agree to a 12-month commitment, paid in 12 installments. The first installment is charged on the purchase date, with subsequent charges occurring monthly. This annual commitment provides uninterrupted access to the BeCare Health platform for 365 days. If a customer wishes to cancel the service before the end of the 12-month term, a penalty fee will be applied. 

  • The penalty fee is the greater of $200 or 90% of the remaining balance on the subscription.
  • Upon payment of the penalty fee, the annual contract will be canceled, and all future scheduled charges will be stopped.
  • Customers may also choose to disable auto-renewal, ensuring that no charges are made after the subscription term ends.
This option allows customers to maintain control over their subscription preferences and plan renewals as needed.
For customers opting for a monthly subscription plan, renewal occurs automatically every 30 days, ensuring continuous access to the BeCare Health platform. The first charge is made at the time of subscription, and subsequent charges are processed monthly on the same date. 

  • If the customer wishes to cancel the subscription, they must contact Customer Support before the next renewal. 
  • Cancellation will only take effect at the end of the current billing period, and no additional charges will be made after confirmation of cancellation. 
  • Failure to request cancellation before renewal implies the automatic continuation of the subscription and the charge for the next billing cycle.

9. Unpaid Payment Notifications

If a payment attempt fails, BeCare Health will immediately notify the customer, advising them to contact Customer Support to resolve the issue. It is the customer's responsibility to ensure that their payment information is accurate and up to date to avoid service suspension. BeCare Health reserves the right to charge interest and penalties on overdue balances, as described in this policy, and to suspend access to services until payment is resolved.

10. Changes to This Refund Policy

BeCare Health reserves the right to modify or update this Refund Policy at any time to ensure compliance with evolving legal standards and customer service needs. Changes will be communicated to current subscribers as appropriate, and continued use of BeCare Health services constitutes acceptance of any revised terms. We recommend periodically reviewing this policy to stay informed of any updates.
